THESE CONDITIONS OF SALE SUPERSEDE ALL PREVIOUS AGREEMENTS.

Please bear in mind that the information published on this website can be changed or withdrawn at any moment and that DeCourcey Turner is not liable for
any inaccurate information.

No person or computer is permitted to bypass any technical protections that we institute, or access, use or scrape the website by any automated means unless you are a search engine crawling the Website for the sole purpose of creating a publicly accessible search index.

STOCK AVAILABILITY

We try as hard as possible to let you know the availability of an item on the website. However, there may be an occasion when a product is not available and
this is not reflected on the site. If this is the case, we will get in touch with you as soon as possible to resolve the issue and discuss an alternative solution ie, when
it will be back in stock, a similarly specified product or simply refund your order so that you can swiftly order the product elsewhere where the item may be in stock.

SUITABILITY OF GOODS

Goods are not supplied on a trial basis. It is your responsibility to ensure that the goods that you order are suitable for your requirements and the purpose for which
you intend to use them before you place your order. It is your responsibility to ensure that drainage and all power supplies and connections are appropriate for
the goods supplied and that the water softeners are fitted in hard water areas. All gas powered goods must be fitted by a GAS SAFE approved fitter and all electrical
goods by a qualified fitter. DeCourcey Turner will NOT accept liability for damage to goods or any other liability or loss caused by incorrect fitting or installation.

We take all reasonable care to ensure that all descriptions, details and specifications are accurate. However, all sizes, colours, dimensions and measurements should be treated as being approximate. Full detailed specifications and further advice are available on request.

You must not use, fit or install any damaged or incorrectly supplied goods whether notified to us or not. If you do, you will be deemed as having accepted the goods and DeCourcey Turner will accept no further responsibility in relation to such goods.

In the event of a failure or breakdown of the goods supplied within the warranty period you must inform us as soon as you become aware of the defect or failure
and in any event before the expiry of the warranty period. DeCourcey Turner will not accept responsibility for any defect or failure of the goods notified after the
expiry of the warranty period whenever the defect or failure occurred.

DeCourcey Turner is not liable for any lost profits or business interruption that may have directly, indirectly or incidentally arisen from a faulty or defective unit. It
is the customers responsibility to plan and prepare for such instances.

The Customer agrees that DeCourcey Turner will NOT be liable for any losses or damage suffered by the Customer including but not limited to damage to neighbouring or connected items or premises, consequential loss, loss of business, business interruption or loss of time due to the use or purchase of the Goods by the Customer. DeCourcey Turner will not be liable for any additional damage caused by the Customer’s failure to report a fault or defect in good time or failure to provide reasonable access to the Goods for repairs, service or engineer visits. Nothing in this agreement shall exclude DeCourcey Turner’s statutory liability for injury or death.

WARRANTY AND LIABILITIES

If you come across any faults or issues with your product after you have purchased it, your first port of call should be the comprehensive “user manual”
that we provide. You can also contact the manufacturer directly or get in touch with DeCourcey Turner if the troubleshooting guides offer no solutions.

If your item requires a warranty call, please follow our warranty procedure detailed with your purchase.

DeCourcey Turner’s product warranty stated on the website product page, order confirmation email and invoice email overrides any warranty details printed in a
manufacturers brochure or found on any other external media including but not limited to a product manufacturers website or brochure.

We reserve the right to take a debit or credit card or other type of payment in advance of arranging a warranty service call. The payment will be refunded if the fault is covered by the manufacturers warranty but will be retained if the product fault or defect is not covered. Examples of exclusions include, but are not limited to: incorrect installation, damage, misuse or lack of maintenance including descaling and cleaning.

PARTS ONLY WARRANTY

A part’s only warranty allows you to use your own sourced fully qualified engineer (at your own cost) to assess the problem. This must be followed by a full engineer’s report sent back to ourselves DeCourcey Turner which we will then forward onto the product manufacturer. Once approved by the manufacturer the parts required will be sent to your desired location. The manufacturer requests that the defective parts are to be sent back on repair of the unit. Failure to send these defective parts back is unacceptable and will result in a full invoice for the replacement parts.

For equipment installed into a mobile catering unit, a non- mainland UK premises or an offshore site will invalidate the standard manufacturers warranty stated on our product pages within this website. In some instances the manufacturers warranty may be limited to a parts only warranty. Please call our office for further information.

BACK TO BASE WARRANTY

Customers must arrange for any faulty unit(s) to be returned to the manufacturer for repair when the items are covered by a back-to-base warranty at their own cost. Please ensure that the item(s) are well packaged as neither DeCourcey Turner nor the manufacturer will accept any responsibility for any loss or damage caused due to poor packaging when the item is in transit.

Please contact DeCourcey Turner to obtain a returns number for your package from the manufacturer. You will need to complete our warranty request form, which requires your signature and an original invoice number.

PAYMENT

All invoices are to be paid in full within 30 days from the date of invoice unless otherwise agreed.

The title of all goods remain vested in DeCourcey Turner and shall not pass to the buyer or the buyer’s customer until all debts owed to DeCourcey Turner, including any existing balances are paid in full. DeCourcey Turner reserve the right to reclaim any goods that remain unpaid under this clause.

No goods may be returned without authorisation from DeCourcey Turner. Any goods returned without authorisation will be refused and returned to sender.

Any order supplied correctly will be subject to a 15% handling fee if returned within 5 working days from delivery. Goods are non-returnable after 5 working days.

Any stock being returned will be the responsibility of the purchaser and any returns need to be in the original non damaged packaging ready for resale.

Special orders and used goods are non-returnable.

Prices for export orders will be quoted ‘ex-works’ and are available on request.

DeCourcey Turner will not be held responsible for any losses incurred in the unlikely event of equipment malfunction.

All discounts offered are settlement discounts and therefore DeCourcey Turner reserve the right to revoke all discounts in the event of late account settlement

DELIVERY

We do as much as possible to ensure that products are delivered to you on time and that you will receive them by the estimated delivery date on the website. However, DeCourcey Turner is not liable for any delays.

Delivery will be to kerbside only unless prior arrangements have been made. The delivery person/driver may at his/her discretion assist with delivering the goods to a location within the premises nominated by the customer, at the customers sole risk.

Deliveries take place between the hours of 8am-6pm Monday to Friday.

For large items the chosen delivery address must be accessible by an 18ton lorry, please contact DeCourcey Turner if your site has any access restrictions. Failure to disclose such information may result in extra costs being incurred by a failed/aborted delivery.

When a product is delivered to you, the first thing you must do is inspect the goods for any damage. Failure to check the goods and document any damage with the driver will result in a claim for damage being rejected. Signing unexamined is not acceptable. In the event that the driver will not wait for you to inspect the goods, please sign for as ‘Damaged’. Once signed as damaged, you must report the damage to DeCourcey Turner in writing within 24 hours to make a claim. If an item has been installed this would deem the product being accepted by the customer and claims for damages may also be rejected.

The buyer must inspect the received goods immediately upon delivery for possible deviations with what has been agreed on. Any complaints regarding the delivered goods must be submitted to Catering Appliance Superstore in writing within 24 hours of delivery. After the expiration of the terms, the delivery shall be deemed irrevocably and unconditionally accepted by the buyer.

Delivery does not include the removal of old units or disposal of packaging materials (pallet, wrapping etc…). Collection and disposal of old units can be selected on a number of our products, in such cases where this service has been requested you must ensure that the items have been unplugged, disconnected, emptied and made ready for collection outside of the premises. If the collection fails, you will still be invoiced the full amount and further collection charges may apply should you wish to rearrange the collection and disposal.

We will charge a redelivery fee if no one is available on site to take delivery of the goods.

A 25% restocking fee of the items value will be charged if delivery fails due to any of the points above, or if the product is returned and is not faulty. Please note that once an order has been placed and despatched the restocking fee will still apply.

Please DO NOT book any fitters or installers of the equipment ordered until after the goods have been delivered and inspected by yourself. We will not take any responsibility for any costs incurred as a result of arranging this in advance of delivery.

RETURNS

Goods sold in the UK mainland may be returned at the customers own cost for a refund providing the product(s) are unused and in their original packaging (this includes any laser film). The restocking charge for returned items is 25% of the full invoiced amount. No goods are accepted for return after 14 days.

Goods deemed non-saleable will not be refunded and will only be returned at the Customer’s cost. Certain large or bulky items may also be subject to a restocking fee (25%). Certain Goods cannot be returned for hygiene reasons. Certain Goods such as knives must be returned in adequate postal packaging for health and safety reasons.

Please note, once an order has been placed and despatched the 25% restocking fee will still apply. Refunds will only be paid once the returned goods have been inspected and after deduction of any restocking charges have been made. We will also deduct any costs for repairing any damage or replacing any missing components that were supplied with the original order.

By placing and order with DeCourcey Turner you are entering into a contract bound by the above warranty and terms and conditions
